Abstract：In judicatory practice of our country，the function of judicial supervision of the prosecuting attorney gradually cannot assort with it's function of public prosecution. This article wants to disclose the misapprehension to judicial supervision through reviewing it's history and practice, dissertate the trend of the judicial supervision -- the supervision in legal procedure , and definitude the role of the prosecuting attorney in the judicial phase.
